Description of My Maxis Store service
This service allows you to use, preview, download and/or subscribe for mobile content product and services as may be provided by Maxis (e.g. video clips, ringtones, operator logos, caller group icons, picture messages, screen savers, SMS games, group messaging services horoscope, jokes, quotes, directory listings, alerts and reminders) and such other products and services as Maxis may from time to time make available to you ("Mobile Content").
To use, preview, download and/or subscribe for the Mobile Content, you will have to be a subscriber of Maxis' postpaid and prepaid mobile service (Hotlink). Please note that you will however be able to download 30 ringtones per day only onto your mobile phone.
Access and usage of this My Maxis Store service shall also be subject to the General Terms and Conditions (which include terms and conditions for Website Use, the Rules of Acceptable Use and the Privacy Statement.
Mobile Content Charges
You will be charged:
- for the cost of usage, subscription, download and/or viewing of the Mobile Content onto your mobile phone at the prices specified for the Mobile Content; and
- where applicable, traffic charges (e.g. SMS and GPRS charges for the transmission / delivery of the Mobile Content to you).
You are advised to check against the specific details of the Mobile Download so as to ascertain the exact charges that are applicable.
Please note that you will be charged for the Mobile Content even if the Mobile Content was used, subscribed, downloaded and/or viewed by a third party using your mobile phone and/or the simcard registered to you and/or your details registered to your simcard. If the mobile phone does not belong to you or if someone else is paying the mobile phone bill please obtain that person's consent prior to using the same.
Payment
You hereby agree to promptly pay all amounts due to Maxis as reflected in your official monthly bill statement and for all charges whatsoever for occasioned by the use of the Service irrespective of whether the such charges were authorized by you or has arisen from any other causes whatsoever.
Registration
Please be informed that for certain Mobile Content, you may be required to register your particulars to be able to use, view and or download the Mobile Content at the relevant webpages. You are required, for this purpose, to provide Maxis with complete and accurate information (eg. name (as per your identification card/passport), address, age etc) about yourself. You must update the said information if there are any changes.
Equipment
You will remain solely responsible to ensure that the mobile phone equipment used by you are compatible for the Mobile Content which you use, purchase or intend to purchase. You will continue to be liable for the Cost of the Mobile Content even if you are unable to use or view the Mobile Content purchased.
If you are unsure whether your mobile phone is compatible with any Mobile Content, please consult your mobile phone handbook or check with the maker of your mobile phone, or refer to the Phone Compatibility Guide which can be found on this Website. Maxis will not be held responsible should you attempt to download an Item onto an incompatible phone.
Delivery of Service
Upon receipt of your request for the Mobile Content, Maxis will send the requested Mobile Content to the given telephone number. If your download request is incomplete or incorrect or if for any reason whatsoever Maxis is unable to provide or deliver the Mobile Content requested, Maxis has the right to decline to send the Mobile Content without further notice to you in which case you will not be charged for the Mobile Content.
Maxis shall not be liable in any way for failures, defects or delays in the delivery of the Mobile Content for any reason whatsoever. You are responsible for all charges incurred if you accidentally erase, replace or delete one of the Mobile Content by receiving another Mobile Content or otherwise.
Termination and Suspension
Maxis reserves the right to cancel, withdraw, terminate or suspend the Mobile Content for any reason whatsoever at its sole discretion without notice to you. You agree that Maxis shall not be liable to you or to any other party for such cancellation, withdrawal, termination or suspension.
Restrictions and Prohibitions
You will abide by all specific conditions and all notifications issued by Maxis in relation to the Mobile Content. Where it is expressly stated that you are restricted or prohibited from storing, editing, transferring, downloading, modifying and/or forwarding the Mobile Content to any other medium, device or to any other user or subscriber, you agree to abide by the conditions. If Maxis is of the view that there has been a contravention of these conditions, Maxis reserves the right to terminate and/or suspend your access and usage of the Mobile Content. |
