Service Specific Terms & Conditions (“SSTC”) – Pakej 5G RAHMAH

- The Offer: -
- Offer One (1): Enjoy RM10 x 24-months rebate when you sign-up for a Hotlink Postpaid 70 Plan with a Samsung Galaxy A14 5G or Honor 90 Lite 5G or OPPO A78 5G or such other eligible Mobile Device as determined by Maxis (“Eligible Mobile Device”) on a 24-months commitment period.
- Offer Two (2): Get an additional RM120 off the Eligible Mobile Device price on top of Offer One (1). Applicable for the first (1st) 100,000 customers only under Pakej 5G RAHMAH.
- You: Person(s) signing up for Hotlink Postpaid 70 Plan (“Participating Hotlink Plan”) during the Offer Period.
- Offer Period: Effective from 31 Aug 2023 until 31 December 2023 (both dates inclusive).
- The Offer, mobile device and the use of the Service(s) is subject to:
- the General Terms & Conditions (“GTC”) at https://www.hotlink.com.my/en/terms-conditions/hotlink/general/;
- this Service Specific Terms & Conditions – Pakej 5G RAHMAH (“SSTC”);
- Service Specific Terms & Conditions for Maxis Device Contract (“SSTC – Maxis Device Contract”) at https://www.maxis.com.my/en/terms-conditions/devices/contract/device-contract/;
- Maxis Fair Usage Policy (“FUP”) at https://www.hotlink.com.my/en/terms-conditions/maxis-fair-usage-policy/; and
- any other applicable terms and conditions, all available at https://www.hotlink.com.my/en/terms-conditions/hotlink/.
- Capitalised terms herein have the same meaning as defined in the GTC.
- Any conflict or inconsistency between this SSTC, SSTC-Maxis Device Contract, GTC and the Summary Terms and Conditions (“STC”), shall be construed in the following order of precedence: (a) this SSTC; (b) SSTC -Maxis Device Contract; (c) GTC and (d) STC.
- We reserve the rights without liability, to revise this SSTC, the GTC, Campaign and our pricing at our sole discretion. Where reasonably practicable, we will give you reasonable advance notice of such changes and all previous versions of our user guides or leaflets will be superseded. You accept that you are responsible for regularly reviewing information on the Plan and Service(s) www.hotlink.com.my/en/terms-conditions/hotlink/, including changes to the Agreement. Your continued use of the Service(s), and/or Plan (after the Effective Date of any revision/change to the terms and conditions of the Agreement, Services, and/or Plan) shall constitute unconditional acceptance by you of such revisions/changes and you shall be bound by the same. If you do not accept such revisions/changes, you will terminate the Plan and/or the use of the Services by giving us written notice within twenty (28) days from the Effective Date, failing which you are deemed to have accepted the changes.
- The Offer: -

- You must be a new Hotlink Postpaid customer who: -
- is at least 18 years of age;
- signs up either Offer One (1) or Offer Two (2) with us; and
- register with Kementerian Komunikasi dan Digital (“KKD”) at Sistem Semakan Pakej Perpaduan Internet (kkd.gov.my), for Offer Two (2) only.
- Eligibility check must be confirmed and verified by the ministry at KKD’s portal at https://pakejperpaduan.kkd.gov.my/
- You are ineligible for the offer if you have any outstanding payments with us.
- The Offer is inapplicable to you if you are a commercial user and/or bulk subscriber.
- You must be a new Hotlink Postpaid customer who: -

- You are responsible for payment of all Charges associated with Participating Hotlink Plan both during and after the Offer Period. Charges exclude applicable taxes.

- To enjoy the RM10 x 24-months rebate under Offer One (1), you must sign-up for Hotlink Postpaid 70 Plan under your name and NRIC with an Eligible Mobile Device a 24-month commitment period contract under Maxis Device Contract plan.
- To enjoy an additional RM120 discount under Offer Two (2), you must first conduct an eligibility check and verification at KKD’s portal at https://pakejperpaduan.kkd.gov.my/

- By participating in this Offer and purchase Eligible Mobile Device under this Offer, you agree to be bound by the SSTC - Maxis Device Contract at https://www.maxis.com.my/en/terms-conditions/devices/contract/device-contract/ and commit to a minimum commitment period of twenty-four (24) months commencing from the date of acceptance of these terms and conditions (“Minimum Commitment Period”). Where applicable, with the acceptance of the SSTC – Maxis Device Contract under this Offer, any previous device contract you had contracted for with Maxis, shall be deemed terminated as at the date of execution of Maxis Device Contract and you shall be subject to any early termination charges of such previous contract.
- During the Minimum Commitment Period described in Clause 15, you must maintain an active account and shall NOT:
- terminate your Hotlink mobile account or port out to another mobile service provider or terminate your Maxis Device Contract;
- suspend your Hotlink mobile account and/or Maxis Device Contract;
- have your Hotlink mobile account and/or Maxis Device Contract terminated for non payment of monthly bills;
- change the rate plan you had registered for pursuant to this Offer to other rate plan. However, any upgrade of a rate plan by you is allowed with an upgrade fee where applicable; and/or
- change or transfer ownership of the Hotlink Postpaid 70 Plan or your Hotlink mobile account or your Maxis Device Contract you signed up for under this Offer.
- If any of the events in Clause 16 above occurs, you shall pay us an early termination charge as set out in Clause 18 below.

- You agree that Maxis has the right to impose an early termination charge and you are responsible to pay such early termination charges if you terminate or cause us to terminate your twenty-four (24) months’ contract before its expiry. The early termination charge is calculated based on [(Recommended Retail Price (RRP) – Upfront Cost (if any)) x (remaining month(s) ÷ 24 months)]. Payment of the early termination charges is payable by you in addition to all monies owing to us up to the time of early termination.
- You acknowledge and agree we have the rights to block the IMEI of the mobile device if you are:
- suspected of fraud or found to have committed fraud; or
- you have reported to us that the mobile device is missing or has been stolen and have requested us to block the IMEI of the mobile device; or
- after signing up the mobile device under this Offer, you fail or have failed to make full payment of any amount due to us within fourteen (14) days of the statement due date.

- We will not be responsible for replacing your mobile device or any part thereof that is lost, stolen, damaged or defective. You shall be responsible for the repair and maintenance of your mobile device. Should a defect or fault fall within the ambit of manufacturer’s warranty, repairs shall be subject to the applicable warranty issued by the Device manufacturer. You accept and acknowledge that the mobile device is subject to the device manufacturer’s standard warranty and we shall not be responsible and/or liable for any loss and/or damage of the mobile device whatsoever suffered by you and/or any other party.

- The mobile device is not returnable, refundable and/or exchangeable upon your acceptance.
- The Offer and/or the mobile device are not encashable.
- We reserve the right at any time or from time to time during the Offer period, to add or change the mobile device brand under this Offer.
- We reserve the right to rescind any of the privileges of your rate plan in the event your line/account registered under this Offer is not used with the mobile device purchased.
- We reserve the rights at any time, without being liable to you or any third party, to interrupt, bar, suspend, restrict the Service(s) for such time as we see fit or terminate, discontinue or disconnect the Service(s) if your usage:-
- shows excessive usage or placing unusual burdens on our Network;
- is for unlawful activities or for suspected fraudulent activities;
- is not in accordance with the FUP; and/or
- is for commercial/non-personal purposes.

- Maxis shall not be liable to you or any other party for any loss or damage of whatsoever nature suffered by a participant or such other party as a result of participation or non-participation in the Offer or as a result of any act or omission on Maxis’ part.
- The terms and conditions stated herein shall be governed by the Laws of Malaysia and subject to the exclusive jurisdiction of the courts of Malaysia.
