Service Specific Terms & Conditions – Hotlink Uni Legends Challenge (“SSTC”)

    1. These terms and conditions (“Terms & Conditions”) set out the terms and conditions in relation to the Hotlink Uni Legends Challenge 2025 (as described in clause 2 hereinbelow) accessible via the Hotlink Uni Legends Challenge 2025 website at https://www.hotlink.com.my/en/campaigns/unilegend-2025/.
    1. In this Terms & Conditions, the following words shall have the meanings ascribed to it:
      1. "Challenge” means the Hotlink Uni Legends Challenge 2025 held by Maxis and/or its authorised representative pursuant to this Terms & Conditions.
      2. "Participant" means a student or team who participates in the Challenge.
      3. “Challenge Organiser” means Maxis and any legal entity or natural person with a valid and legally enforceable arrangement, agreement and/or contract with Maxis to organise this Challenge.
      4. “Website” refers to the Hotlink Uni Legends Challenge 2025 website at https://www.hotlink.com.my/en/campaigns/unilegend-2025/.
      5. “Terms & Conditions” means this Terms & Conditions, and any alteration, modification, change or update which may be made to the Terms & Conditions at any time and from time to time.
      6. “You” means the Participant where applicable as the context requires.
    1. For more information in relation to the Challenge, you can refer to the Website at https://www.hotlink.com.my/en/campaigns/unilegend-2025/ or Hotlink sales ground activations in university campuses.
    1. Participation
      1. In order to register for the Challenge, you warrant and represent that:
        1. you are an active student at a public university in Malaysia;
        2. you are residing in Malaysia throughout the entire period of the Challenge;
        3. you are at least eighteen (18) years old and have the ability to contract. If you are under the age of eighteen (18), your parent or legal guardian must read and agree to this Terms & Conditions on your behalf. If you are the parent or legal guardian of a minor who registers for the Challenge, you consent to the registration of the Challenge by your child or minor in your custody in accordance with this Terms & Conditions, and agree that you will be responsible for the registration of and/or participation in the Challenge, by your child or minor in your custody;
        4. you are using your actual identity; and
        5. the personal particulars that you have provided upon registration of and/or participation in the Challenge, are true, accurate, complete and current.
      2. By participating in the Challenge, you agree to provide to Maxis your personal and event information and consent to Maxis viewing, processing and storing the same.
      3. The criteria for shortlisting event proposals for the pitching stage are listed on the event campaign page. Participants are advised to refer to the Website for detailed information.
      4. You agree and acknowledge that you have read, understood and accepted all the Challenge mechanics as set out on the Website. Maxis reserves the right to update the mechanics at any time and from time to time without prior notice.
      5. By submitting any materials for the Challenge, Participants warrant and represent that they are the original creators of the work and have not copied or derived it from any other source without proper authorisation or citation.
      6. Participants must ensure that all submissions, including but not limited to event proposals, presentations, and any related materials, are original and do not infringe upon the intellectual property rights of any third party.
      7. In the event that a submission is found to be plagiarised or infringing upon the rights of others, the Challenge Organiser reserves the right to disqualify the Participant and take appropriate action, including but not limited to legal proceedings against the Participant.
      8. Participants are encouraged to maintain records and documentation of their creative process to demonstrate originality if required.
      9. All proposals must comply with all applicable laws and regulations. Any content and/or event that is offensive, illegal, or inappropriate, such as gambling, racism, or fraud, is strictly prohibited.
      10. It shall be your sole responsibility and obligation to ensure that you comply with and do not contravene any laws to which you may be personally subject to.
      11. To the maximum extent permitted by law, you agree to defend, indemnify and hold Maxis, its directors, officers, employees, representatives, agents, sponsors, and the Challenge Organiser harmless from and against any and all claims, actions, suits or proceedings as well as any losses, damages, liabilities, costs and expenses (including legal fees) arising out of or accruing from any non-compliance and breach by you of these Terms & Conditions or any breach of applicable laws, including but not limited to any alleged infringement of intellectual property rights due to your submissions or any illegal activities related to your proposed and/or actual events.
    1. Pitching stage
      1. You agree for Maxis to contact you in email or any form of communication method to notify you should your event be shortlisted for the pitching stage.
      2. You agree to travel to the pitching location and pitch your event proposal in person as determined by Maxis should your event proposal be shortlisted. All reasonable travel expenses incurred in the pitching stage of the Challenge will be covered by Maxis. For the avoidance of doubt, all expenses apart from the said reasonable travel expenses (including but not limited to all additional and incidental costs and expenses) shall be borne by you.
      3. In the event the Participant declines the pitching invitation or is unable to participate in the pitching stage for whatsoever reason, the invitation will be offered to the next proposal in line.
      4. You agree to adhere to the Challenge schedule as stated on the Website. Late or no show during the pitching stage may result in disqualification from the Challenge.
      5. The allocation of funding for winner’s event under the Challenge is at the sole discretion of Maxis. You acknowledge and agree that the decision of Maxis regarding funding allocation is final and binding, and no correspondence or appeal will be entertained by Maxis at any time during or after the Challenge.
    1. Dispute and issue
      1. You agree to immediately notify the Challenge Organiser in the event there is any dispute or issue arising from or in relation to the Challenge. The Challenge Organiser shall investigate your complaint and respond to you as soon as practicable.
      2. Any complaint(s) you may have shall be made within seven (7) days from the conclusion of the pitching stage in accordance with clause 3.4(a) above.
      3. The Challenge Organiser reserves the right to reject, refuse and/or not respond to your complaint in the event you fail to make your complaint in accordance with clause 3.4(a) and clause 3.4(b) above.
      4. For the avoidance of doubt and irrespective of the validity of your complaint, in no event and under no circumstances shall the Challenge Organiser and/or Maxis be liable to compensate you for any losses or damages you incurred or may incur due to and/or arising from your participation in the Challenge.
    1. Minimum participation for the Challenge
      1. You agree and acknowledge that the Challenge Organiser reserves the sole right to cancel the Challenge in the event the actual number of participants in the Challenge is below six (6) event proposal submissions. The prizes of the cancelled Challenge will be forfeited and will not be accumulated into the next Challenge, if any.
    1. Event Funding
      1. The event funding provided in the Challenge will be credited into the treasury of the participating university, provided all Challenge requirements and obligations have been met by the Participants. The university is responsible for managing and disbursing the funds in accordance with the approved event proposal and ensuring compliance with all applicable terms and conditions.
      2. You agree, acknowledge and consent to the Challenge Organiser viewing and processing your event funding fulfilment details, which include but not limited to winner’s name as per National Registration Identity Card (NRIC) or Passport, phone number, email address, university’s bank name, university’s bank account holder name and/or bank account number for event funding fulfilment purposes.
      3. You agree and acknowledge that Maxis shall have the rights to, amongst others, delay delivery, refuse delivery and/or forfeit the event funding in the event you fail to provide true and accurate event funding fulfilment details or if you breach any of these Terms & Conditions. In such an event:
        1. Maxis shall not be liable for any losses or damages which you may suffer or have suffered as a result therefrom; and
        2. you agree to unconditionally and irrevocably waive all claims in relation to the event funding, and release Maxis from any liability arising from and/or in connection with the event funding.
      4. Fulfilment of the event funding will be completed within thirty (30) days after Maxis receives the complete and accurate fulfilment details from the winners. Participants must ensure that all required fulfilment details are submitted promptly to avoid any delays in the funding process.
    1. During the course of your participation in the Challenge, you shall not at any time, directly or indirectly engage in any of the following activities ("Restricted Activities"):
      1. Use vulgar or provocative language during the entire Challenge within any communication channel;
      2. Use a proposal name that is deemed vulgar, offensive, discriminatory, or infringing on copyright;
      3. Accuse any participant without proof.
    1. Participants who are caught directly or indirectly engaging in any of the Restricted Activities will receive punishment including but not limited to warning, disqualification, suspension from any future Challenges, as deemed appropriate by the Challenge Organiser.
    2. In the event of any claims made against Maxis and/or the Challenge Organiser due to the commission or alleged commission of any of the Restricted Activities, the Participants agree to defend and hold Maxis and/or the Challenge Organiser harmless against, and indemnify Maxis and/or the Challenge Organiser for, any and all damages and losses incurred or may incur by Maxis and/or the Challenge Organiser on a full-indemnity basis.
    1. Maxis shall be the exclusive sponsor of the awarded event. Participants agree not to engage any other sponsors without prior written consent from Maxis.
    2. Maxis reserves the right to bring relevant reward partners to join the event. Participants agree to collaborate with these partners as part of the event execution.
    3. Participants agree to defend, indemnify and hold Maxis harmless from any claims, damages, or liabilities arising from any alleged infringement or illegal activities related to their proposed and/or actual events.
    1. The personal information/personal data supplied by you when participating in the Challenge will be used by Maxis in accordance with its privacy policy in the Maxis Privacy Notice. Please refer to the Maxis Group Privacy Notice by visiting the website (https://www.maxis.com.my/en/privacy-notice/) for more information as participation in this Challenge is an agreement to be bound by that privacy policy, which shall form an integral part of this Terms & Conditions.
    2. The personal information/personal data collected may be used in future by Maxis to provide you with further information about similar events and information in relation thereto, which you may opt out of by informing Maxis of your decision to do so. Your personal information/personal data is subject to the safeguards concerning privacy and security of data as set out in the Maxis Group Privacy Notice and the Personal Data Protection Act 2010.
    3. You shall ensure that all personal information/personal data provided to Maxis are accurate and correct at the point of submission and that Maxis is kept informed and updated of any change in your personal information/personal data.
    1. By (i) participating in the Challenge; and/or (ii) being a Challenge winner, you expressly grant permission to Maxis and its agencies and reward partners the right to use your name, photograph and/or likeness, video, recording, testimonial or other media item (if any) and to post information about the Challenge and your submission (“Materials”), in whole or in part and in any manner as Maxis may see fit, for purposes of advertising, editorial, promotional, marketing, trade and/or other purposes at Maxis’ website, social media account, digital platforms and any other media outlets without further compensation and notice to you. You (being the Participants of the Challenge and/or the Challenge winner(s)) release Maxis, its directors, officers, employees, representatives, and agents from all claims and demands arising out of or in connection with any use of the Materials including but not limited to claims for invasion of privacy, defamation and any other personal or proprietary rights. Any person who does not want to have their Materials used, distributed or information disseminated must inform Maxis in writing of his/her intentions via email at unilegends@maxis.com.my.
    1. Maxis reserves the right, in its sole discretion:
      1. to exclude you from participation in the Challenge if (i) you are found to be in violation of these Terms & Conditions, (ii) you have found to have made any derogatory, disparaging or critical remarks, comments or statements about Maxis; or (iii) Maxis believes you have undertaken fraudulent practice and/or activities or other activities damaging, destructive, or detrimental to the image and reputation of Maxis. For the avoidance of doubt, fraudulent activities include but are not limited to any act of deceit, deception, cheating and/or misrepresentation of any kind.
      2. at any time, to change any aspect of the Challenge (including but not limited to the Challenge period, eligibility criteria, participation requirement, winning criteria) without prior notice to you or any of the participants.
      3. to modify, change, postpone, suspend and/or cancel the Challenge at its sole and absolute discretion for any reasons or without giving any reason whatsoever, and excludes any and all liabilities and/or claims arising from or in relation to the said modification, change, postponement, suspension and/or cancellation of the Challenge and any technical faults, issues and/or disruption occurred during the Challenge for whatsoever reasons. By your continued participation in the Challenge, you will be deemed to have accepted any modification or changes to the Challenge.
    1. In no event shall Maxis be liable to you or to anyone else for any loss or injury or for any direct, indirect, incidental, consequential, special, exemplary, punitive or any damages whatsoever, whether in contract, negligence or in tort, including but not limited to loss of revenues, loss of profits, lost data or other intangible losses arising out of or in relation to your participation in the Challenge including (without limitation) any postponement, suspension and/or cancellation of the Challenge.
    2. You agree to waive any and all claims against Maxis and/or the Challenge Organiser for any damages, losses, and/or expenses you incurred or may incur as a result of any modification, change, postponement, suspension and/or cancellation of the Challenge and any technical faults, issues and/or disruption occurred during the Challenge.
    3. Maxis shall not be liable to you, the participants or any other party for any loss or damage of whatsoever nature suffered by you or such other party as a result of participation or non-participation in the Challenge or as a result of any act or omission on Maxis’ part.
    1. You agree and acknowledge that Maxis shall have the rights to alter, modify or change these Terms & Conditions periodically without prior notice given to you. You are therefore, advised to visit the Website from time to time. The date of publication, and any update, of these Terms & Conditions is stated at the top of these Terms & Conditions.
    2. Any changes to these Terms & Conditions shall come into effect upon publication of the updated Terms & Conditions on the Website. You agree and acknowledge that your continued participation in the Challenge after the updated Terms & Conditions come into effect shall constitute, and be deemed as your acceptance to the applicable updated Terms & Conditions at the material time.
    1. These Terms & Conditions shall be governed by the laws of Malaysia and subject to the exclusive jurisdiction of the courts of Malaysia.
