Service Specific Terms & Conditions ("SSTC") - Hotlink Prepaid 1.0

Version Date: 18 January 2024

    1. The Plan: Hotlink Prepaid 1.0.
    2. You: Person(s) signing up this Plan.
    3. The Plan and Service(s) is subject to the General Terms & Conditions ("GTC") at https://www.hotlink.com.my/en/terms-conditions/hotlink/personal-hotlink-prepaid/general/general-tnc/, this Service Specific Terms & Conditions ("SSTC"), Maxis Fair Usage Policy at www.maxis.com.my/FUP and any other applicable terms and conditions, all at www.hotlink.com.my/tnc.
    4. Capitalised terms herein have the same meaning as defined in the GTC.
    5. Any conflict or inconsistency between this SSTC, the GTC and Summary Terms and Conditions ("STC"), shall be construed in the following order of precedence: (a) SSTC; (b) GTC; and (c) STC.
    6. We reserve the rights without liability to revise this SSTC, Plan and our pricing. Where reasonably practicable, we will give you reasonable advance notice of such changes and all previous versions of our user guides or leaflets will be superseded. You accept you are responsible for regularly reviewing information on the Plan, Service(s) at www.hotlink.com.my/tnc, including changes to the Agreement. . If you do not accept such revisions/changes, you are required to terminate the Plan and/or the use of the Services under the Plan in accordance with this SSTC by giving us notice within 28 days from the Effective Date failing which you are assumed to have accepted the changes. Save where terminated based on the foregoing, any continued use of the Service(s), and/or the Plan (after the Effective Date of any revision/change to the terms and conditions of the Agreement, Services, and/or Plan) shall constitute unconditional acceptance by you of such revisions/changes and you shall be bound by the same.
    1. The Plan is only eligible for new Hotlink Prepaid activation customers, Mobile Number Portability (MNP) customers or customers requesting for change rate plan from others prepaid plan.
    2. You are ineligible for this Plan if you owe us any payments.
    3. The Plan is inapplicable to you if you are a commercial user and/or bulk subscriber.

    (collectively, “Eligible Customer”).

    1. Your top-up amount for prepaid services will determine the number of active-days to make calls, SMS, and access to the internet (“Active Period”).
    2. The rates for the call, SMS and MMS under this Plan are as below:

    Charges per the applicable rates set by the respective service provider of the special numbers.

    1. After the end of the Active Period, you can only receive incoming calls and SMS until the next top up or 50 days from the end of Active Period, whichever is earlier (“Credit Grace Period”). During the Credit Grace Period, all or any balance from unutilised prepaid credit and/or unutilised mobile internet data will be suspended from usage until the next top-up.
    2. You must top-up to resume full Service(s) of the Plan before the end of the Credit Grace Period. Failure to top-up before the end of the Credit Grace Period will result in termination of the Plan and any untilised prepaid credit will be forfeited.
    1. All existing Hotlink Prepaid customers of any prepaid plan can request for a change of plan from your existing prepaid rate plan to this Plan via Hotlink app. You will be charged a fee of RM5.00 which is deductible from your prepaid account upon successful change to this Plan.
    2. Upon successful change to this Plan, the following shall apply:
      1. your account lifecycle active period will be replaced with 30 days active-days from the date of the successful change, and the Credit Grace Period will be reset to 50 days;
      2. all existing domestic internet passes subscriptions from your previous rate plan will be terminated; and
      3. all internet passes subscriptions from your previous rate plan cannot be carried forward to this Plan.
    1. Under the Plan, you are entitled to purchase from USSD and Hotlink app for the internet passes as set out below:

    1. The unlimited internet passes as set out in clause 16 above have an uncapped speed from 8pm-8am in 5G network only. These unlimited internet passes have usual internet capped speed (6Mbps/12Mbps) in 5G network outside 8pm-8am.
    2. All unlimited internet passes are subjected to Maxis Fair Usage Policy at https://www.maxis.com.my/en/terms-conditions/personal/general/maxis-fair-usage-policy/.     3. All internet passes are non-auto renewable.
    4. All internet passes are strictly for personal usage only.
    5. Unlimited Voice Call Quota as stated under clause 16 includes domestic fixed landlines, mobile lines, emergency numbers and 1800 numbers. Charges may apply to any call made to special numbers (eg. 1300/121/20018).
    1. In order to use 5G internet pass under this Plan (“5G Internet Pass”), you must:-
      1. have a 5G capable, supported and enabled Mobile Device to access/ utilize the 5G network. Please check the latest list of 5G capable, supported and enabled Mobile Device at https://www.maxis.com.my/en/about-maxis/5g-network/#eligible-devices, which list may be updated from time to time. A 5G software update from the device manufacturer maybe required which will not be the responsibility of Maxis;
      2. located within the 5G network coverage area. A map of 5G network coverage area can be found at https://www.maxis.com.my/en/about-maxis/5g-network/; and
      3. have a 4G LTE enabled SIM. You may check your SIM status by dialing this code *100*6*1*4# from your phone.
    2. The 5G Internet Pass may be subject to other terms, conditions or stipulations as may be prescribed by the Ministry of Communications and Multimedia, the Malaysia Communications and Multimedia Commission and/or Maxis’ third party service provider of the national 5G wholesale network from time to time.
    3. Maxis reserves the right to alter the 5G availability criteria at any time.
    1. 5G Internet Pass under this Plan is only available within the 5G network area via use of a 5G capable, supported and enabled Mobile Device. If you are located outside the 5G network coverage area, you’ll automatically switch to any of our other available networks.
    2. Maxis does not represent, warrant, understand and/or guarantee that the 5G Internet Pass will be:
      1. provided without errors;
      2. uninterrupted; and/ or
      3. that your experience of the existing services which you are subscribing from Maxis on our other available networks will not be impacted in an adverse manner;
        and that Maxis will and is able to correct or rectify all or any part of the errors, interruption or such adverse impact to the existing services. You understand and acknowledge that the services offered pursuant to the 5G Internet Pass may be subject to limitations, delays and other problem inherent in communication facilities and network and/or the third party 5G network, including the internet and Maxis shall not be responsible to you and/or any third party for any delays, delivery, failures, or other damage or loss resulting from or in connection with such problem.
    3. Without derogating from the disclaimer and limitation of liability under the GTC which are applicable to you, Maxis makes no representation or give any condition, indemnity, warranty, guarantee, whether express or implied, about whether the services offered pursuant to the 5G Internet Pass will operate and be compatible with any Content, Equipment, hardware or software or that it will be compatible with the national 5G wholesale network. You acknowledge and agree that Maxis relies on one or more third party service providers in relation to the 5G Internet Pass (including its availability and continuity) and as such, to the fullest extent permitted by law, Maxis excludes any liability and shall not be liable to you and/or any third parties whether in contract, tort or otherwise for any loss, damage or liability incurred or sustained by you and/or any third party (including loss of revenue or loss of services or connectivity) caused by or in relation to any delay, failure, breakdown, inability to use or access, interruption or disruption by any of our third party service providers including Maxis’ third party service provider of the national 5G wholesale network or in respect of interruption or adverse impact to existing services subscribed from Maxis arising from your purchase of the 5G Internet Pass.
    4. Notwithstanding anything to the contrary in this SSTC, you acknowledge and agree that: -
      1. you have not relied on any representation, warranty, statement or similar made by Maxis’ third party service provider of the national 5G wholesale network in connection with your decision to use or the manner in which you will make use of the 5G Internet Pass including where such 5G Internet Pass is provided to you as part of products or services (or bundled products or services) by Maxis;
      2. you are solely responsible for your decision to use, and the manner in which you will make use of, the 5G Internet Pass and does so at your own risk (including where the 5G Pass is used in connection with the preservation of life or property);
      3. you are solely responsible for making your own decisions on appropriate alternative redundancy, connectivity and data solutions in the event the 5G Internet Pass is unavailable, disrupted or operate with error;
      4. the 5G Internet Pass will not necessarily operate without error and will not always be available;
      5. Maxis’ third party service provider of the national 5G wholesale network does not owe you any duty of care or similar duty and you release Maxis’ third party service provider of the national 5G wholesale network from any liability arising from your use of the 5G Internet Pass; and
      6. you must not do anything that may interfere with Maxis’ third party service provider of the national 5G wholesale network and/or connect or knowingly permit any third party to connect any equipment to the 5G network.
    1. Under the Plan, you are entitled to purchase from USSD and Hotlink app for the IDD bundle as set out below:

    1. The IDD bundle is applicable for both fixed lines and mobile lines.
    2. The IDD bundle is also applicable to both premium IDD and IDD 132 calls.
    1. Eligible Customer who fulfills the following criteria and conditions are entitled for Hotlink Cashback Voucher when the Eligible Customer purchases the Qualifying Products (as defined in Clause 33) via Hotlink app under this Plan: -
      1. Eligible Customer who is a Malaysian citizen and aged below 24; OR
      2. Eligible Customer who has registered the Plan via our dealer’s channel located in the following states at East coast of Malaysia and East Malaysia:
        1. Kelantan
        2. Terengganu
        3. Pahang
        4. Sarawak
        5. Sabah
        6. Labuan
      (collectively, “Qualifying Criteria”)
    2. The Qualifying Products and the amount of the Hotlink Cashback Voucher to be earned are as follows: -

    1. Hotlink Cashback Voucher is issued on every purchase of each of the Qualifying Product via Hotlink app.
    2. The Hotlink Cashback Voucher once claimed is valid for 33 days from the issuance of the same by us via Hotlink app. There shall be no extension of the expiry date. Eligible Customer may redeem and use this voucher for the next purchase of eligible Hotlink products, consist of:-
      1. Qualifying Products as per Clause 33; or
      2. 30 days internet pass under HotlinkMU deals. Refer to https://www.hotlink.com.my/en/terms-conditions/services/hotlinkmu/ for HotlinkMU Terms & Conditions.
    3. Hotlink Cashback Voucher are
      1. Non-refundable;
      2. Not transferable to any person or entity;
      3. Cannot be exchanged for cash;
      4. Cannot be used in conjunction with other discounts, privileges or promotional offers, unless otherwise specified by maxis; and
      5. Not stackable with other voucher which may be issued by Maxis;
    4. For the avoidance of doubt, Eligible Customer who is unable or fail to meet the Qualifying Criteria will not be entitled for Hotlink Cashback Voucher.
    5. Maxis reserves the rights and discretion to determine, amend and/or alter the Qualifying Criteria, Qualifying Products and the terms and conditions in respect of Hotlink Cashback Voucher, from time to time without notification to you.
    1. We reserve the rights at any time at our sole discretion whether with or without notice to you and without being liable to you and/or any third party, to immediately interrupt, bar, suspend or restrict the Plan (including 5G Internet Pass) for such time as we see fit, withdraw or terminate, discontinue or disconnect the services including if:
      1. any technical failure occurs in services pursuant to the Network (which includes any network operated by any third party which are connected to Maxis’ network);
      2. the services pursuant to the 5G Internet Pass, our Network or systems are being upgraded, modified or maintained;
      3. your usage shows excessive usage or placing unusual burdens on our Network;
      4. in our determination that the Plan is or may be used by you for unlawful activities or for suspected fraudulent activities;
      5. your usage is not in accordance with the Maxis Fair Usage Policy (at www.maxis.com.my/FUP) or contrary to any of the terms and conditions of this SSTC and/or the GTC;
      6. is for commercial/non-personal purposes;
      7. where matters beyond our reasonable control prevents us from performing and/ or continuing our obligations this SSTC, the GTC and/or the Maxis Fair Usage Policy;
      8. you have relocated or have been relocated to an area outside the 5G network coverage area; or
      9. we are required to do so by law, statute, enactment, regulations, code or by any relevant authorities, including the Maxis’ third party service provider of the national 5G wholesale network.
    2. where no prior notice is provided, Maxis may to the extent commercially reasonably practicable give you notice of such changes in any form as Maxis deem reasonable or appropriate.
