Our decisions in any matter in relation to this Offer shall be final and conclusive and any request for appeal or review will not be entertained. All charges and prices stated are exclusive of all applicable taxes. Any applicable taxes shall be charged and added to the bills issued to you. In the event of any conflict or inconsistency between this SSTC and the GTC, the SSTC shall prevail over the GTC to the extent of such conflict or inconsistency. If any provision in these terms and conditions is held to be invalid, illegal and unenforceable under any applicable law or court of law or by any reasons whatsoever, the legality and enforceability of the remaining provisions shall not be affected or impaired in any way and such invalid, illegal or unenforceable provision shall be deemed deleted.

The eligibility to this Offer is subject to the following criteria: A new principal line must be registered in your name, and you must maintain an active account under any of the Participating Postpaid Plans. For clarity, active means you are able to make and return calls. This offer is available exclusively through selected Maxis Centres, Maxis Exclusive Partners, and other authorized stores designated by Maxis. Purchases made through other non-authorized sales channels will not be eligible for this Offer. For further details, please refer to Appendix 1, which includes the complete list of selected stores. Please note that this list may be updated from time to time. You are not eligible for this Offer if you: (a) have any outstanding payments with us; or (b) are a commercial user and/or bulk subscriber. Notwithstanding the above, Maxis reserves the right to change the eligibility criteria for this Offer from time to time.

Rebate Period and Termination

The Rebate will be reflected in your Bill during the Rebate Period as provided in Clause 1(a). You shall NOT during the Rebate Period: terminate your Participating Postpaid Plan(s); suspend your Participating Postpaid Plan(s); downgrade your Participating Postpaid Plan(s); have your Postpaid account terminated for non-payment of monthly Bills; change or transfer ownership of your Participating Postpaid Plan(s) to another person; convert your Participating Postpaid Plan(s) to any Hotlink prepaid rate plan; and/or sign-up for a new device contract. If you terminate your Participating Postpaid Plan after its activation date, or if any of the events in Clause 16 above occurs during the Rebate Period, you will no longer be entitled to the Rebate and the Rebate will be forfeited/cancelled from your Participating Postpaid Plan(s), with immediate effect. Maxis reserves the right to terminate the Services under this Offer in the instance you suspend the Services under this Offer for any period exceeding three (3) consecutive months. Subject to our GTC, a principal line holder may at any time terminate the Plan(s) as follows: by calling our customer care line at 1-800-82-1123 or dial 123 from your mobile; by walking into our Maxis Centres listed on www.maxis.com.my ; or by writing in to customercare@maxis.com.my.

Subscribe to the Plan with Port Request

In the event your Port request to us is still pending from the DNO, and you wish to subscribe to the Participating Postpaid Plan(s) before successful Porting of your Mobile Number to Hotlink/Maxis, you confirm, agree and understand that: the mobile number provided by us will be attached to the Merchandise purchased under this Plan (“ Interim Mobile Number ”) with a SIM Card or eSIM (“Hotlink/Maxis’ SIM Card or Hotlink/Maxis’ eSIM”), as the case maybe; the Plan shall be effective and commence on the date of registration for the Plan and not on the date of which your Port request is successful; and you shall make and continue to make payment for the Charges associated to the Plan (including the Charges for the Device purchased) from the date of registration of the Plan regardless of whether your Port request to Maxis is successful. In the event your Port request is successful within thirty (30) days from the date of registration of the Plan, you confirm and agree that: we will swap or switch the Interim Mobile Number to your Mobile Number provided by the Donor (“ Your Mobile Number ”) at our end. In this case, Service to the Interim Mobile Number will be deactivated. You must make request to us separately if you wish to retain the Interim Mobile Number which such request is subject to registration on any Maxis’ mobile plan and strictly subject to availability; and we will notify you of the successful Port-in and Service of Your Mobile Number will be available on the Hotlink/Maxis’ SIM Card or Hotlink/Maxis’ eSIM and you may discard your previous SIM provided by the DNO. In the event your Port request is not successful after thirty (30) days from the date of registration of the Plan or where your Port request failed, is rejected by the DNO or unsuccessful, for whatsoever reasons, you confirm and agree that: we shall not be liable or responsible to you or any third party for any loss or damage whether direct, indirect, special or consequential, or for loss of business, revenue or profits or of any nature suffered by you, or any other person, or any injury caused to or suffered by a person or damage to property; the Interim Mobile Number shall automatically become your new Hotlink/Maxis Mobile Number line without notice from us; you shall remain responsible and liable for the Charges (including the Charges for the merchandise purchased) associated with the Plan; and if you decide to terminate the Plan, you shall responsible for the termination charges as set out in clause 22 above. For the avoidance of doubt, should this section applies to you, clause 12 of the GTC (save for clause 12.8) shall be applicable to you.

We will not be responsible for replacing your Merchandise or any part thereof that is lost, stolen, damaged or defective. You shall be responsible for the repair and maintenance of your Merchandise. Should a defect or fault fall within the ambit of manufacturer’s warranty, repairs shall be subject to the applicable warranty issued by the Merchandise manufacturer. You accept and acknowledge that the Merchandise is subject to the merchandise manufacturer’s standard warranty and we shall not be responsible and/or liable for any Merchandise purchased from us and/or for any loss and/or damage whatsoever suffered by you and/or any other party.

Non-Exchangeability and Non-Returnability

The Offer cannot be exchanged for cash and the Merchandise is not returnable upon acceptance of this SSTC.
