Service Specific Terms & Conditions (“SSTC”) – Hotlink Postpaid Mobile Internet Service

General

  1. The Service: Hotlink Postpaid Mobile Internet Service (“MI Service”)
  2. You: Person(s) signing up for the Service.
  3. The MI Service is a service provided by us which allows you to connect to and access the Internet, both via mobile devices or personal computers
  4. The use of the MI Service are subject to the General Terms & Conditions (“GTC”), Service Specific Terms & Conditions (“SSTC”), Maxis Fair Usage Policy (www.maxis.com.my/FUP) and any other applicable terms and conditions, all at (www.maxis.com.my/tnc/personal)
  5. Capitalised terms herein have the same meaning as defined in the GTC.
  6. Any conflict or inconsistency between this SSTC, the GTC and Summary Terms and Conditions (“STC”), shall be construed in the following order of precedence: (a) SSTC; (b) GTC; and (c) STC.
  7. We reserve the rights without liability, to revise this SSTC, Plan(s) and our pricing. Where reasonably practicable, we will give you reasonable advance notice of such changes and all previous versions of our user guides or leaflets will be superseded. You accept you are responsible for regularly reviewing information on the Plan(s) and Service(s) at www.maxis.com.my/tnc), changes to the Agreement. Your continued use of the Service(s) and/or Plan(s) (after the Effective Date of any revision/change to the terms and conditions of Services and/or Plan(s)) shall constitute unconditional acceptance by you of such revisions/changes and you shall be bound by the same. If you do not accept such revisions/changes, you will terminate the Plan(s) and/or the use of the Services by giving us notice within 28 days from the Effective Date failing which you are assumed to have accepted the changes.

 

Eligibility

  1. You must be 18 years old and above and a Hotlink postpaid service subscriber to use, preview and/or subscribe to the MI Service.
  2. You are ineligible for MI Service if you have any outstanding payments with us.
  3. This Product is not applicable to you if you are a commercial user and/or bulk subscriber.

 

Delivery of Service

  1. You can subscribe for the MI Service via UMB, Mobile Application (Hotlink Flex App).
  2. Once you have subscribed to the MI Service, you will have to wait for an SMS confirming activation of the MI Service before using the MI Service.
  1. All the available Hotlink postpaid data packages and applicable rates are capped based on the time/usage (quota entitlement), which are set out in the attached MI Service Appendix.
  2. The postpaid data packages under the MI Service packages terms and conditions are referred to as follows:
    1. The Hotlink Postpaid 1 Day Pass of 1GB is categorized and referred to as “Time-based Passes” with pass validity of 24 hours.
    2. The 4GB auto-renew pass is referred to as “Auto-renew Pass”.
    3. The 2GB one-time pass is referred to as “One-time Passes” with pass validity of 31 days or until the end of bill cycle, whichever comes first.
    4. The Unlimited Chat, Social and Music bundles are referred to as “Unlimited Bundles Auto-Renew” with pass validity of 31 days or until the end of bill cycle, whichever comes first.
    5. The Unlimited Chat, Social and Music bundles are referred to as “Unlimited Bundles” with pass validity of 31 days or until the end of bill cycle, whichever comes first.
  3. Subject to respective passes’ terms and conditions, you may purchase a single Auto-renew Pass at any one time. While an Auto-renew Pass is still valid, you cannot purchase another Auto-renew Pass. At the end of your bill cycle, the Auto-renew Pass will be automatically renewed and the monthly volume entitlement will be refreshed. If you subscribe to the Auto-renew Pass, your monthly commitment fee will be pro-rated against your billing cycle date. You will be charged the full commitment fee from the second month onwards but with full mobile internet package allocation from the first month. You can opt to terminate your Auto-renew pass by calling our Contact Centres (123);
  4. Subject to respective passes’ terms and conditions, you may purchase any number and/or combination of the Time-based Passes or One-time Passes. However, if you wish to purchase another Time-based Pass (which is the same as the one you have just purchased) or One-time Pass (which is the same as the one you have just purchased), you can only do so after thirty (30) minutes lapse from the first purchase.
  5. Subject to respective passes’ terms and conditions, you may purchase any combination of Unlimited Bundles passes but you may only have one of each type of Unlimited Bundle.
  6. We may charge you (customers) for any previous Services or usages consumed by you, that may not have been charged in your previous bills.
  1. Subject to respective passes’ terms and conditions, you may purchase a single Auto-renew Pass at any one time. While an Auto-renew Pass is still valid, you cannot purchase another Auto-renew Pass. At the end of your bill cycle, the Auto-renew Pass will be automatically renewed and the monthly volume entitlement will be refreshed. If you subscribe to the Auto-renew Pass, your monthly commitment fee will be pro-rated against your billing cycle date.   3. Subject to respective passes’ terms and conditions, you may purchase any combination of Unlimited Bundles passes but you may only have one of each type of Unlimited Bundle.
  4. We may charge you (customers) for any previous Services or usages consumed by you, that may not have been charged in your previous bills.

 

Roaming

  1. The rates outlined in Table I – Hotlink Postpaid Mobile Internet rates of the Appendix do not account for usages while on an overseas roaming network. For international roaming data usages, you will be subject to the rates as stipulated at https://www.maxis.com.my/en/personal/services/addons/idd-and-roaming/international-roaming.html
  2. Whilst you are on data roaming, each data session is split evenly on the home network and the overseas roaming network. Hence, you will incur data charges for both the local portion within the Maxis network and again for the same usages on the overseas roaming network.


Usage Benefits

  1. The order of utilization for the volume entitlement shall be as follows:
    1. Unlimited Bundle Passes, for the respective applications as outlined in Table I – Hotlink Postpaid Mobile Internet
    2. For Time-based Passes and One-time Passes, whichever expires first shall have its volume entitlement exhausted first;
    3. Auto-renew Passes
    4. Hotlink postpaid mobile internet package allocation

Unlimited Bundle Passes
  1. The unlimited internet usage is only valid for the related passes and their applications as outlined in Table I – Hotlink Postpaid Mobile Internet
  2. The Unlimited Bundle Passes are subjected to a monthly Fair Usage Policy of 1TB per month. Upon exhaustion of the internet quota under the Fair Use Policy, internet quota will be deducted from the next available internet pass in accordance with the order of utilization set out above.
  3. We will ensure, on a best efforts basis that all traffic associated with the Unlimited Bundle Passes is covered. However, there may be some usage that may be drawn from your normal volume entitlement, which would otherwise have been drawn from your Unlimited Bundle Pass volume entitlement. This may be due to various reasons, including:
    1. System issues such as whitelisting or configuration of internet protocol addresses;
    2. Access to third party data within the applications as outlined in Table I – Hotlink Postpaid Mobile Internet; and/or
    3. Changing of URLS and IP addresses by the the applications as outlined in Table I – Hotlink Postpaid Mobile Internet without sufficient notice to update our system.

You acknowledge the possibility of this happening and agree that Maxis shall not be liable and/or responsible if you under such circumstances.

 

 

Things we may do to the MI Service

  1. We reserve the rights at any time, without being liable to you or any third party, to interrupt, bar, suspend, restrict the Service(s) for such time as we see fit or terminate, discontinue or disconnect the Service(s) if your usage:
    1. shows excessive usage or placing unusual burdens on our Network;
    2. is for unlawful activities or for suspected fraudulent activities;
    3. is not in accordance with the Maxis Fair Usage Policy (at www.maxis.com.my/FUP); or
    4. is for commercial/non-personal purposes.
    5. is to prevent network congestion, traffic from peer-to-peer software/applications (such as BitTorrent, eDonkey, Gnutella) or file sharing software (such as Limewire) are blocked from the hours of 6am to 12am (Midnight) every day.
  2. You will abide by all conditions, restrictions and notifications issued by us in relation to the MI Service. If we are of the view that there has been a contravention of these terms and conditions, we reserve the rights to terminate and/or suspend your access and use of the MI Service.

 

Status of usage for MI Service

  1. As a customer subscribing for MI Service, the following methods enable you to be informed of the status of usage for the MI Service:

            SMS Notifications

  1. You will receive a SMS notification to inform you that your usage (as at the time set out in the SMS notification ("Time Stamp"), not the time of your receipt of the SMS notification):
    1. has reached 60% of the volume quota for the data package which you have subscribed for ("60% Notification"); and/or
    2. has exhausted the entire volume quota for the data package which you have subscribed for ("100% Notification").
    3. if you have exhausted the entire volume quota for the data package which you have subscribed for before your receipt of the 60% Notification, you will only receive the 100% Notification.
  2. Without limitation to these terms and conditions, you acknowledge and agree: (i) the SMS notification is for your convenience only; (ii) the SMS notification received from us may be delayed; and (iii) The information in the SMS notification is system generated, based on the records as at the Time Stamp, not the time of your receipt of the SMS notification and the information may not be up to date at the time you received the SMS notification; and (iv) we are not liable for any error or omission of information in the or non-receipt of the SMS notification and shall not be liable to you for any damages, loss, expenses, claims, demands or costs of any kind arising from such circumstances.


Check Status Function

  1. You may check your volume quota usage for the MI Service via (UMB) by selecting the 'Check Status' option in the Mobile Internet menu; or MyMaxis App (Mobile Application) by logging in using your Maxis Mobile ID
  2. You acknowledge and agree: (i) the Check Status Function is for your convenience only; (ii) the receipt of the information using the Check Status Function may be delayed; (iii) the information received using the Check Status Function is system generated, based on the records as at the Time Stamp, not the time of your receipt of the said information and it may not be up to date at the time you received it; and (iv) we are not responsible for any error or omission of information from your use of or non-receipt of the Check Status Function and shall not be liable to you for any damages, loss, expenses, claims, demands or cost of any kind arising from such circumstances;

 

Equipment

  1. The MI Service can be used on all SIM-based devices. You are solely responsible to ensure that the Mobile Phone or device used by you is compatible and enables you to use the MI Service.
  2. You continue to be liable for any and all charges incurred in connection with the MI Service even if you are unable to use the MI Service purchased or subscribed to. If you are unsure whether your Mobile Phone or device is compatible for use of the MI Service, please refer to your mobile phone or device handbook or check with the manufacturer of your mobile phone or device. Maxis shall not be liable and/ or responsible if you be unable to use the MI Service as a result of the make or model or functionality limitations of your Mobile Phone or device.

Termination

  1. Subject to our GTC, a principal line holder may at any time terminate the MI Service by calling our customer care line at 1-800-82-1123 or dial 123 from your mobile
